It gives them two valuable things: First, a Bad Guy on whom to blame everything. This bullshit amounted to a ~10% tax on their shady business practices. Less than what they should already be paying in income taxes. If anything it’s incentive to find more ways to dick over their customers. One can only hope that either:
- If a Democrat, Hell even a proper capitalist who understands that strong regulation is paramount to capitalism’s lasting survival, ever gets a chance to sit in the Oval again she, or someone with her ideals, is nominated to lead FTC, FCC, SEC, IRS, etc…
- After the current regime is overthrown and democracy is restored, see previous bullet-point.

Like for sure you can’t share legally protected data (copyright, trade secret, and the like) but talking disparagingly seems like a pretty obvious first amendment violation.
And I know that protects you from the government, but who’s enforcing the stipulations of such an NDA?
